Test Prep Group Classes and Summer Camp Terms & Cancellation Policies

This Student Enrollment Terms and Conditions, as amended from time to time, (“Agreement”) is between Ramsey Tutoring llc, d/b/a Smith Street Workshop (SSW) a New York corporation with its principal place of business at 607 Henry Street, Brooklyn, New York 11231 and its affiliates (“SSW” or “we”) and you (“you” or “Student”).

By enrolling your student into one of our group classes you hereby agree that you have read and downloaded, saved, and/or printed a copy of this Agreement for your records. If you have any questions, you can email our office at info@smithstreetworkshop.com or call us at (347) 335-0026.

COURSE AND SUMMER CAMP WITHDRAWAL & REFUND POLICY.  If you need to withdraw from your course or summer camp session, you must notify Smith Street Workshop in a writing (email acceptable and preferred) that is actually received by Smith Street Workshop.

Because our course and summer camp sessions fill up quickly, we have the following cancellation policies in place:

1) If you notify us a month before the class and summer camp session begins, you can apply for a 100% credit for a future enrollment at Smith Street Workshop, or a 75% refund.

2) If you notify us up to two weeks before the class or summer camp session begins, you may receive a 100% credit for a future enrollment at Smith Street Workshop, or a 50% refund.

3) One week before the class or summer camp session begins, we cannot make adjustments or offer credits

Transfer Policy.  Smith Street Workshop, in its sole discretion and only under extreme circumstances, may grant you a transfer from a course or summer camp session in which you are currently enrolled into another course or summer camp session currently offered at Smith Street Workshop or another course or summer camp session offered at Smith Street Workshop on a future date.  Transfers are only granted by Smith Street Workshop under extreme circumstances and are subject to seat availability.  Smith Street Workshop makes no guarantee of the ability to transfer or of seat availability in a subsequent course or summer camp session. You will not be refunded the difference of cost if you transfer into a less expensive course or summer camp session.  However, if you transfer into a more expensive course or summer camp session then you will be required to pay Smith Street Workshop the difference in the price. If you are on a payment plan when you transfer into a new course or summer camp session, the payment dates will not change.

INTELLECTUAL PROPERTY.  All intellectual property rights in Smith Street Workshop courses and course materials, whether in-class or online, including without limitation designs, copyrights, database rights, trademarks, patents, application to register any of the aforementioned rights, trade secrets and/or know how, are and shall remain the exclusive property of Smith Street Workshop.  You may not, without the express written consent of Smith Street Workshop, reproduce, copy, disseminate, broadcast, or otherwise use any intellectual property owned or controlled by Smith Street Workshop, including any intellectual property contained in any course materials or trademarks used by Smith Street Workshop.

PUBLICITY & NAME & LIKENESS. During the time that you are a student at Smith Street Workshop, persons may film or photograph you while you are on Smith Street Workshop property.  You hereby consent to Smith Street Workshop’s use of your name image, likeness, and voice in connection with Smith Street Workshop as an academic enrichment center.  You agree that any appearance in a photograph or video may be edited in Smith Street Workshop’s sole discretion and that you may be portrayed in any way Smith Street Workshop reasonably determines.  You expressly release Smith Street Workshop, Smith Street Workshop’s agents, employees, licensees, subcontractors and assigns from and against any and all claims which you have or may have for invasion of privacy, defamation or any other cause of action arising out of production, distribution, broadcast, exhibition, marketing or promotion of the Smith Street Workshop promotional material or other Smith Street Workshop related materials in which you may appear.

LIMITATION OF LIABILITY. Smith Street Workshop’s liability to you hereunder shall be limited to the total amount you have actually paid to Smith Street Workshop for the applicable course. Except as set out herein, Smith Street Workshop shall under no circumstances be liable to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any indirect or consequential loss arising hereunder or in connection with the courses provided by Smith Street Workshop or the use or operation of any Smith Street Workshop equipment or facilities. Nothing in this. Smith Street Workshop: (i) Accepts no responsibility for loss, damage or theft of personal belongings; (ii) Reserves the right to cancel courses or summer camp session at any time and to transfer bookings to rescheduled dates. Students unable to attend rescheduled dates may be entitled to some refund or other credit; and (iii) Takes no responsibility for the quality of services or products provided or offered by third party advertisers and/or vendors. Inclusion in the course materials or presence during a course is not a recommendation or endorsement by Smith Street Workshop.

While it is our mission to provide the best educational services possible, clients  understand that Smith Street Workshop does not guarantee any specific outcomes as a result of tutoring or test prep classes.

GENERAL RELEASE: IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN THE ACTIVITIES PROVIDED BY SMITH STREET WORKSHOP (SSW), WE RELEASE, WAIVE, DISCHARGE SSW FROM, AND COVENANT NOT TO SUE OR BRING ARBITRATION AGAINST SSW FOR, ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS AND CAUSES OF ACTION OF ANY KIND OR NATURE ARISING OUT OF OR RELATED TO ANY LOSS, DAMAGE OR INJURY, THAT WE, ANY OF OUR PROPERTY OR ANY OF THE STUDENT’S PROPERTY MAY SUSTAIN RESULTING FROM, OR IN ANY WAY CONNECTED WITH, THE STUDENT’S PARTICIPATION IN SUCH ACTIVITIES, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF SSW AND REGARDLESS OF WHETHER SUCH LIABILITY ARISES IN TORT, CONTRACT, STRICT LIABILITY OR OTHERWISE.

FORCE MAJEURE. For the purposes of this Agreement, “Force Majeure Event” means any event beyond the reasonable control of Smith Street Workshop including without limitation strikes, lock-outs or other industrial disputes (whether involving the workforce of the party or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, including governmental visa status, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors.  Smith Street Workshop shall not be liable to you as a result of any delay or failure to perform its obligations under this Agreement as a result of a Force Majeure Event.  If the Force Majeure Event prevents Smith Street Workshop from providing a course or other services promised to you, Smith Street Workshop shall, without limiting its other rights or remedies, have the right to terminate this Agreement immediately by written notice.

STUDENT CODE OF CONDUCT. Maintaining a conducive learning environment is one of our highest priorities at Smith Street Workshop (SSW). For our test prep courses and small group sessions, we ask that all students acknowledge and agree to be held responsible for adhering to our Student Code of Conduct.

  • Students will take responsibility for their own learning.

  • Students will respond to instructors in a respectful manner.

  • Students will behave in a safe manner in relation to themselves, others, and property.

  • Students will respect their classmates learning time

  • No cell phones at any time during instruction. Barring an emergency situation, students will not be permitted to text, call or use phones in any other way during instruction. 

Our instructors will not tolerate any conduct that substantially interferes with the maintenance of appropriate order in the operation of our classes. Such conduct includes, but is not limited to Inappropriate behavior that causes a disruption of teaching, administration, or other classroom activities

SSW instructors are experienced in leading and managing a classroom and will always attempt to verbally resolve any behavior concerns on site. It is our hope that any behavior issues can easily be resolved by parents working in cooperation with instructors. However, in the (unlikely) event that a behavior issue cannot be satisfactorily resolved, the parent/guardian may be asked to withdraw their student from the enrichment class or group session.

If we begin to recognize a pattern of disruptive conduct, and are unable to resolve the matter on site, we will take the following steps:

1) In writing, escalate the matter to the parent/guardian’s attention for resolution.

Instructor may ask the student to step out of the classroom (and work independently on an assignment in the main tutoring room) for a short period of time so that the lesson is not disrupted for other students in the class.

2) If the matter persists in the following class, we will notify the parents with a final written notice or phone call.

Instructor may ask the student to step out for the remainder of class (and work independently on an assignment in the main tutoring room) so that the lesson is not disrupted for the other students in the class.

3) After the final written notice, non-remediation will result in the student’s withdrawal from class.

In the event that a student withdraws from a class or group session, we will apply a credit to your account for the remaining sessions, which may be used for private tutoring sessions at the Workshop. We are unable to provide a refund if a student is asked to withdraw from a course for behavioral issues.


Individual Tutoring Terms & Cancellation Policy

Tutoring Prepayment Discount Terms and Conditions

Families who commit to a full semester of tutoring are eligible for a 5% discount contingent upon prepayment of individual tutoring sessions. The fall semester is September - December 20 and the spring semester is January - June 21.

The discount applies only if payment is received in full by 9/30 for the fall semester and 1/31 for the spring semester.

Cancellation policy:

1) Cancellations with less than 24 hours' notice will incur a full lesson charge. 

2) Reschedule requests with more than 24 hours' notice: Each student is allowed 3 cancellations per semester. Cancellations will be applied as a credit towards future sessions if makeups are unable to be scheduled.

3) Credits must be used before the end of each semester (December 20 and June 21, respectively) and do not carry-over.


Inclement Weather Policies

Individual Tutoring Session

In the event of inclement weather (snow, sleet, hail, flooding, tornado, hurricane, severe thunderstorm) we will leave it up to the discretion of the family and tutor as to whether or not a lesson will be held.  

When there is inclement weather, tutors and families may email info@smithstreetworkshop.com on lesson days if they wish to cancel the lesson, and so at least 3 hours prior to the session in order for us to contact both parties.

Small Group Session and Group Classes

In the event of inclement weather (snow, sleet, hail, flooding, tornado, hurricane, severe thunderstorm), Smith Street Workshop reserves the right to cancel the class. In a case of cancellation, families and tutors will be contacted via email at least 2 hours prior to the start of the class. Please note that in the (very rare) case of group class cancellations, there will be no make-ups or refunds.
